Historically, an irrevocable trust was irrevocable. However, this is not necessarily the case with certain statutes that are available in 26 states. The presenter will take the audience through the process of decanting an irrevocable trust in order to demonstrate how a trust decanting can essentially amend an irrevocable trust. Even better, there are four key trust jurisdictions that allow a Private Decanting which means that the beneficiaries don’t need to receive copies of the trusts and therefore don’t see trusts that the client wants to remain private. The ability to move a trust to one of these key jurisdictions will be a key feature of this presentation. The audience will come away with a technique that should open up doors for many of their clients.
